Kaavyaratna Group is the lawful owner/developer and rights holder in relation to the project “Kaavyaratna Vasudha”. We have identified unauthorized publication and commercial use of our proprietary project information and intellectual property on the MagicBricks platform, including an unauthorized project page/listing relating to Kaavyaratna Vasudha. The concerned project page is available at: https://www.magicbricks.com/kaavyaratna-vasudha-koba-gandhinagar-pdpid-4d4235343531343233 The unauthorized content includes, among other things, project information, project images, brochures, floor plans, specifications, branding/trademarks and other proprietary material belonging to Kaavyaratna Group. The content is being displayed, promoted and used for property marketing and lead-generation purposes without our knowledge, authorization, licence or consent. Kaavyaratna Group has already formally notified MagicBricks of its objection and demanded removal of the unauthorized content. Despite such notice and expiry of the compliance period provided by us, the concerned content/project page continues to remain accessible. MagicBricks has stated that the project information is available through Google Search and/or that users can create property listings on its platform. This does not address our complaint. Our objection is specifically to the unauthorized hosting, reproduction, display, dissemination, promotion, commercialization and lead generation of Kaavyaratna Group’s proprietary project content on the MagicBricks platform. The fact that content may have been uploaded by a third party does not constitute authorization from Kaavyaratna Group. We have expressly notified the platform that the concerned content is unauthorized and have requested its removal. We therefore request the competent authority/grievance body to take appropriate action and direct the concerned platform to: 1. Immediately remove the unauthorized Kaavyaratna Vasudha project page/listing and all associated content. 2. Remove unauthorized project images, brochures, floor plans, specifications, pricing information, branding, trademarks and other proprietary material belonging to Kaavyaratna Group. 3. Cease further publication, reproduction, display, advertising, promotion, commercialization and lead generation relating to the project without Kaavyaratna Group’s prior written authorization. 4. Preserve relevant records concerning the creation, publication and operation of the unauthorized listing, subject to applicable law. 5. Provide confirmation of removal and compliance. 6. Take reasonable measures to prevent continued unauthorized publication of the same proprietary material through associated listings or pages. Kaavyaratna Group reserves all rights and remedies available to it under applicable Indian law, including remedies relating to copyright, trademark, intellectual property, passing off, unauthorized commercial use and other applicable legal causes of action. This complaint is being submitted after prior direct communication and notice to the concerned platform and the failure to satisfactorily resolve the issue. We request urgent intervention and appropriate directions for removal of the unauthorized content.
